GDPR legislation comes into force

The General Data Protection Regulation (GDPR) comes into force today (25th May 2018) and the associated provisions in the UK Data Protection Act 2018 are also now in effect.

Whilst welcoming the new rights for individuals, Information Commissioner Elizabeth Denham has also sought to reassure organisations that her Office’s (the ICO) focus would be on companies that “deliberately, persistently or negligently misuse data”.

In a recent blog article, Ms Denham stated:

“The creation of the Data Protection Act 2018 is not an end point, it’s just the beginning, in the same way that preparations for the GDPR don’t end on 25 May 2018. From this date, we’ll be enforcing the GDPR and the new Act but we all know that effective data protection requires clear evidence of commitment and ongoing effort.”

Ms Denham also told BBC Radio 4’s Today programme that they are not looking for perfection but rather a commitment to moving forward, and would not be making early examples of small businesses.

Contractors should be making good progress to GDPR compliance but ought to remember that this is a ‘journey’ and today is the start and not the end of GDPR compliance.
