PSNC Terms and Conditions

  1. Cancellations

1.1.    The following will apply if PSNC cancels an event:*

1.1.1. Where practicable, PSNC will notify you of the cancellation of an event you have booked, no later than ten days before it is due to run. PSNC will notify you by email whenever possible, but if you have not provided an email address, we shall notify you by post.

1.1.2. A notice that an event has been cancelled will also be posted on our website either in the LPC members area (where the event is restricted to LPC representatives) or on the main PSNC website where the events are not so restricted.

1.1.3. Under the circumstances where the event is to be rescheduled, PSNC will notify you and invite you to transfer your booking to that alternative date.

1.1.4. Please make sure that your contact details are correct when registering for an event with us.

1.1.5. If we cancel an event we shall refund any payments made to PSNC by you for attendance at the meeting.

1.1.6. If we reschedule an event, and you inform us within 10 days of our sending of the notice that you do not wish to attend the rescheduled event, we shall refund any payments made to PSNC by you for attendance at the meeting.

1.1.7. We shall not be responsible for any consequential costs caused by the cancellation or rescheduling of events.

*In exceptional circumstances PSNC may cancel an event at very short notice – due to ill health, fire at venue, etc. In this event PSNC will make all reasonable endeavours to notify you before the scheduled start date and time.

1.2.    The following will apply if you cancel a booking:

1.2.1. All cancellations must be notified to PSNC at events@psnc.org.uk

1.2.2. PSNC will respond within seven working days and will provide a cancellation reference to all requests for cancellation.

1.2.3. No fee will be charged where PSNC has received notification of the cancellation ten days or more prior to the event date.  In such circumstances a full refund will be made via the same payment method used in the original payment.

1.2.4. No refund will be made for any cancellations made less than ten days prior to the event, but another person can be substituted at no cost providing PSNC is notified at events@psnc.org.uk.  PSNC must be notified with the name and contact details for the substitute at least 48 hours in advance of the event. N.B. LPC members must substitute with other LPC members only.

2. Written communications

2.1.    When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

3. Notices

3.1.    All notices given by you to us must be given to the PSNC at events@psnc.org.uk. We may give notice to you at either the email or postal address you provide to us when booking an event with us. When posted on our website or by sending an email, Notice will be deemed to have been given and properly served 24 hours after the website has been amended or the email is sent.  Where the postal service is used, Notice will be deemed to have been given and properly served three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.

4. Events outside our control

4.1.    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (“Force Majeure Event”).

4.2.    A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

4.2.1. strikes, lock-outs or other industrial action

4.2.2. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war

4.2.3. fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster

4.2.4. impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport

4.2.5. impossibility of the use of public or private telecommunications networks

4.2.6. the acts, decrees, legislation, regulations or restrictions of any government.

4.3.    Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

5. Severability

5.1.    If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

6. Entire agreement

6.1.    We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract.  No variation to these Terms and Conditions will be valid, unless these are confirmed in writing by a duly authorised agent of PSNC.

7. Our right to vary these terms and conditions

7.1.    We reserve the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

7.2.    You will be subject to the policies and terms and conditions in force at the time that you book to attend any events with us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to all bookings made by you existing at the time of the change).

7.3.    If we change these terms and conditions between the time at which you submit a booking for an event, but before we confirm that event, the new terms and conditions will be notified to you with our confirmation of booking, and you will be deemed to have accepted those changes unless you notify us to the contrary within seven working days of receipt of the notice.

8. Law and jurisdiction

8.1.    Contracts for the booking attendance at our events through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

9. Privacy Policy

9.1.    Personal data (eg name, address, email address) provided by you in the course of booking an event is stored by PSNC in order to provide the services linked to the event.  In the course of booking the event, you will be asked if we may continue to store your personal data in order to contact you in the future, to promote further events or services that we may offer, improve the services that we provide, or to provide information relevant to the work of PSNC.

9.2.    We will not share personal information provided by you in booking an event with any third party, other than those linked with the event (including but not limited to delegate lists that may be provided to attendees for information; and to events centres and caterers to provide any accommodation and catering associated with the event).

9.3.    We will ensure that all personal data supplied is held in accordance with the Data Protection Act 1998.

9.4.    Subject to paragraph 9.2 above, PSNC does not sell or otherwise transfer personal data to any third parties unless you have consented to this or this is permitted by law.

9.5.    If you email us to ask a question, we will use the personal data you provide only to reply to your message. We may retain a copy of the emails associated with your query, for our records, but we will not share it with any third party unless you have consented to this or this is permitted by law.

9.6.    This privacy statement applies to centrally maintained PSNC web pages and eventsforce links created and maintained by PSNC.  PSNC is not responsible for the protection and privacy of any information which users have provided whilst visiting other third party websites. Accordingly, users should exercise caution and review the privacy statement applicable to the website in question.
