  1. Cancellations

1.1.    The following will apply if Community Pharmacy England cancels an event:*

1.1.1. Where practicable, Community Pharmacy England will notify you of the cancellation of an event you have booked, no later than ten days before it is due to run. Community Pharmacy England will notify you by email whenever possible, but if you have not provided an email address, we shall notify you by post.

1.1.2. A notice that an event has been cancelled will also be posted on our website either in the LPC members area (where the event is restricted to LPC representatives) or on the main Community Pharmacy England website where the events are not so restricted.

1.1.3. Under the circumstances where the event is to be rescheduled, Community Pharmacy England will notify you and invite you to transfer your booking to that alternative date.

1.1.4. Please make sure that your contact details are correct when registering for an event with us.

1.1.5. If we cancel an event we shall refund any payments made to Community Pharmacy England by you for attendance at the meeting.

1.1.6. If we reschedule an event, and you inform us within 10 days of our sending of the notice that you do not wish to attend the rescheduled event, we shall refund any payments made to Community Pharmacy England by you for attendance at the meeting.

1.1.7. We shall not be responsible for any consequential costs caused by the cancellation or rescheduling of events.

*In exceptional circumstances Community Pharmacy England may cancel an event at very short notice – due to ill health, fire at venue, etc. In this event Community Pharmacy England will make all reasonable endeavours to notify you before the scheduled start date and time.

1.2.    The following will apply if you cancel a booking:

1.2.1. All cancellations must be notified to Community Pharmacy England at events@cpe.org.uk

1.2.2. Community Pharmacy England will respond within seven working days and will provide a cancellation reference to all requests for cancellation.

1.2.3. No fee will be charged where Community Pharmacy England has received notification of the cancellation ten days or more prior to the event date.  In such circumstances a full refund will be made via the same payment method used in the original payment.

1.2.4. No refund will be made for any cancellations made less than ten days prior to the event, but another person can be substituted at no cost providing Community Pharmacy England is notified at events@cpe.org.uk.  Community Pharmacy England must be notified with the name and contact details for the substitute at least 48 hours in advance of the event. N.B. LPC members must substitute with other LPC members only.

2. Written communications

2.1.    When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

3. Notices

3.1.    All notices given by you to us must be given to the Community Pharmacy England at events@cpe.org.uk. We may give notice to you at either the email or postal address you provide to us when booking an event with us. When posted on our website or by sending an email, Notice will be deemed to have been given and properly served 24 hours after the website has been amended or the email is sent.  Where the postal service is used, Notice will be deemed to have been given and properly served three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.

4. Events outside our control

4.1.    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (“Force Majeure Event”).

4.2.    A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

4.2.1. strikes, lock-outs or other industrial action

4.2.2. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war

4.2.3. fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster

4.2.4. impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport

4.2.5. impossibility of the use of public or private telecommunications networks

4.2.6. the acts, decrees, legislation, regulations or restrictions of any government.

4.3.    Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

5. Severability

5.1.    If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

6. Entire agreement

6.1.    We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract.  No variation to these Terms and Conditions will be valid, unless these are confirmed in writing by a duly authorised agent of Community Pharmacy England.

7. Our right to vary these terms and conditions

7.1.    We reserve the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

7.2.    You will be subject to the policies and terms and conditions in force at the time that you book to attend any events with us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to all bookings made by you existing at the time of the change).

7.3.    If we change these terms and conditions between the time at which you submit a booking for an event, but before we confirm that event, the new terms and conditions will be notified to you with our confirmation of booking, and you will be deemed to have accepted those changes unless you notify us to the contrary within seven working days of receipt of the notice.

8. Law and jurisdiction

8.1.    Contracts for the booking attendance at our events through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
